Yes, in many cases. The staff member can be sued directly, and the facility can be liable for negligent hiring, supervision or retention, or for ignoring complaints. Some states also hold employers responsible for certain staff misconduct under vicarious liability rules. ### Does it matter that I was an adult and seemed to agree? Often it does not defeat a claim. Patients in treatment depend on staff for care, housing and discharge decisions, and many states treat sexual contact between staff and patients in treatment settings as misconduct or a crime regardless of apparent consent. A lawyer can explain how your state treats it. ### Will my addiction treatment records become public if I sue? Federal rules at 42 CFR Part 2 give substance use disorder records stronger protection than ordinary medical records, including limits on their use in legal proceedings against the patient. You can also ask the court to let you file under a pseudonym. Your lawyer can seek protective orders for records used in the case. ### Are sober living homes regulated like rehab centers? Usually not. Many recovery residences are not licensed treatment facilities, and oversight ranges from voluntary certification programs to none at all, depending on the state. Claims against sober homes often rely on general negligence and premises liability law. ### I signed an arbitration agreement at admission. Can I still sue? Possibly. Federal law lets survivors of sexual assault or sexual harassment choose court instead of arbitration under many pre-dispute agreements, and courts sometimes refuse to enforce admission agreements signed during detox or crisis. A lawyer should review the document. ## Policies - [Sponsored content policy](https://legalherald.com/sponsored-content-policy/) - [Editorial standards](https://legalherald.com/editorial-standards/)
